BRIEF OF CLAIM FOR A WIDOW'S PENSION

In the Case of Eleanor Wallace, widow of Hugh M. Wallace, it ______of captain Black's Company, Colonel______Reg't, Ohio. Mil._________________________________________

Residence, Clarke County, Ohio, Post Office address, Donnelsville, Clarke County Ohio. Soldier enlisted August 24th, 1812, Discharged February 24th, 1813.

Declaration and identification in due form, filed May 13th, 1872

SERVICE FOR SIXTY DAYS SHOWN AS FOLLOWS:

Report from Bounty Land Division shows service in Captain Black's Co. Ohio Mil. From Aug 24th 1812 to Feb 24th 1813.

Total service, 185 days. Soldier died Feb 15th, 1864, date and fact established by testimony of Peter Sintz and James

Continued widowhood since his death established by testimony of Kemp Gaines and James Thompson. Marriage to soldier prior to February 17, 1815, established by testimony of Jane Cook and John Richison who were present at the marriage giving date thereof July 6th 1814. Maiden name of claimant Eleanor Richison.

Before me the undersigned authority in and for said county personally came Jane Cook aged 68 years, who being duly sworn says: That she well knew Hugh M. Wallace deceased and Eleanor Richison, and that they were married on the 6th day of July 1814 and she knows it from the fact that she was present at the marriage ceremony and has refreshed her memory by reference to circumstances accurate therewith. Who further states that she has no interest in the claim of said Eleanor Wallace for pension and that her J. O.(sp) dwelling is Burlington Carroll County Indiana.

Before me, Judge of the Court of Probate in and for said County, personally came John Richison, who being duly sworn says that he well knew one Hugh M Wallace deceased who was a soldier in Capt Sam'l Black's Co. Ohio Militia--War of 1812 and with his wife (now widow) Eleanor Wallace-formerly Eleanor Richison-and that he was present at the wedding of said Hugh M. Wallace and Eleanor Richison and was an eye witness of the ceremony which occurred on the 6th of July 1814 in Clarke Co., Ohio- and further that he is not interested in the widows claim for pension.

Who as a soldier of War 1812 and that they know said soldier died on Feb 15, 1864 and that they are not interested in the widows claim for pension- Their residences are Clarke Co., Ohio.

WAR OF 1812

DECLARATION OF A WIDOW FOR PENSION.

To be executed before Judge or Clerk of Court

State of Ohio

County of Clarke

On this fourth day of May A.d. eighteen hundred and seventy-two personally appeared before me, E.G.Dial of the Court of Probate, a Court of Record in and for the county and State aforesaid, Eleanor Wallace, aged seventy-eight years, a resident of the County of Clarke, State of Ohio, who, being duly sworn according to law, declares that she is the widow of Hugh M. Wallace, who served the full period of sixty days in the (1) Military service of the United States in the War of 1812, and who was the identical Hugh M. Wallace who (2) was drafted in Captain Samuel Black's Company, Ohio Militia Regiment, ______Brigade, ________,Division at can't give date, on the __________ day of____ 1813 and was honorable discharged at _________________ on the can't give date _________ day of ___________, 181 ; that (3) he was in engagement at the Rafner's near the _______sp. (A land warrant was granted).

That she was married under the name of Eleanor Richison to said Hugh M. Wallace on the Sixth day of July, A. D. 1814, by Rev. Vickers at Clarke County Ohio, there being no legal barrier to such marriage; that her said husband died at Donnelsville, Clarke Co., Ohio, on the fifteenth day of February, 1864, and that she has not remarried since his death; that at no time during the late rebellion against the authority of the United States did she or her said husband adhere to the cause of the enemies of the Government, giving them aid or comfort; or exercised the functions of any office whatever under any authority, or pretended authority, in hostility to the United states; that she will support the Constitution of the United States; that she is not in receipt of a pension under any previous act; that she makes this declaration for the purpose of being placed on the pension rolls of the United States, under the provision of the act approved February 14, 1871, and hereby constitutes and appoints, with full power of substitution and revocation, H. S. Shomers of Springfield, Ohio her true and lawful attorney, to prosecute her claim, and obtain the pension certificate that may be issued; that her post office is at Donnelsville, County of Clarke, State of Ohio; that her domicile or place of abode is Bethel Township, Clarke, Co., Ohio

Also personally appeared James Thompson and Kemp Gaines residing in Clarke Co., Ohio, persons whom I certify to be respectable and entitled to credit, and who being by me duly sworn, say: They were present and saw Eleanor Wallace, the claimant, sign her name (or make her mark) to the foregoing declaration; that they have every reason to believe from the appearance of said claimant, and their acquaintance with her, that she is the identical person she represents herself to be, and she has not remarried since the death of her husband, but remains his widow; and at no time during the late rebellion against the authority of the United States did she, or her said husband, adhere to the cause of the enemies of the government, or give them aid or comfort; and that they have not interest in the prosecution of this claim.
